On September 18, 2015, the Environmental Protection Agency notified Volkswagen that it violated the Clean Air Act when installing a “defeat device” which circumvents emissions standards by giving false readings when tested. “Using a defeat device in cars to evade clean air standards is illegal and a threat to public health“, said EPA’s Cynthia Giles.

Volkswagen’s former CEO, Martin Winterkorn, resigned after taking responsibility for the emissions cheating scandal. The New Times, September 23, 2015. Subsequently, the company’s CEO in the United States admitted to Congress that the device was installed for the very purpose of cheating the tests. VW car owners believed they were buying or leasing a vehicle advertised as a “clean car” when in fact the affected vehicles might emit pollutants up to 40 times the legal limit.
